These Terms and Conditions ("Terms") govern your use of the website www.mgmenergyng.com (the "Site") and any products, services, and installations provided by MGM Energy Ltd ("MGM Energy", "we", "us", or "our").

MGM Energy Ltd is registered in Nigeria (CAC: RC 1478239) with its office at Kwanar Freedom Radio, Sharada, Kano, Nigeria. By accessing or using our Site or placing an order with us, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Scope of Services

We design, supply, install, and maintain solar panels, batteries, inverters and other solar power solutions for residential, commercial, and industrial customers in Nigeria. Specific details of each project (including system size, components, pricing, and timelines) will be set out in your quotation, invoice, or contract.

2. Eligibility

By using our Site or placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract under Nigerian law.

3. Quotations, Orders and Pricing

  • All quotations are indicative and subject to a site survey, product availability, and foreign exchange or other market fluctuations.
  • Prices are stated in Nigerian Naira (₦) unless otherwise indicated and may be exclusive of applicable taxes, delivery, and installation charges.
  • An order is considered accepted once you have made payment (full or part, depending on the agreed terms) and we have confirmed your order in writing (email, SMS, or invoice).

4. Payment Terms

Payments are processed through our payment partners, including Paystack, or by bank transfer or other methods we may specify. Payment details, including card information, are handled directly by the payment processor and not stored by MGM Energy.

You are responsible for providing accurate billing information and ensuring that you have the necessary authorisation to use the chosen payment method.

5. Shipping, Delivery and Installation

  • Delivery timelines will be communicated during the order process. These are estimates and may vary due to logistics, product availability, or other factors beyond our control.
  • Where installation is included, we will agree a date and time window with you. You are responsible for providing safe access to the site and ensuring all necessary permissions (e.g. landlord, building management) are in place.
  • On completion of installation, you (or your representative) may be asked to sign a job completion form confirming that the work has been carried out.

6. Order Cancellation and Returns

Because our products are often procured specifically for your order and may be configured to your requirements:

  • Once an order has been processed and shipped, it cannot be cancelled.
  • If you wish to cancel before processing and shipment, please contact us immediately at info@mgmenergyng.com or +234 816 816 4166. We will inform you whether cancellation is still possible and any applicable charges.

If the product does not meet your expectations

If the delivered product appears faulty, damaged, or not suitable for your needs, please contact us as soon as reasonably possible after delivery with your order details, photos, and a description of the issue. We may:

  • inspect the product on-site or request that you bring it to an approved centre;
  • repair or replace the product where appropriate; or
  • work with you to specify a more suitable product or configuration, which may involve additional costs or credits, depending on the circumstances.

We strongly recommend that you contact us for technical advice before placing an order so we can help you choose a system that matches your usage patterns, site conditions, and budget.

7. Warranties

  • Manufacturer warranties for solar panels, inverters, batteries, and other hardware apply as stated by the respective manufacturers.
  • Our installation workmanship warranty (if applicable) will be described in your project documentation.
  • Warranties may be voided by tampering, improper use, unauthorised modifications, poor ventilation, water damage, or failure to follow our maintenance instructions.

8. Customer Responsibilities

You agree to:

  • Provide accurate information during quotations and order placement.
  • Ensure that your premises are structurally suitable for the installation (e.g. rooftop strength, space for batteries and inverters).
  • Obtain any necessary third-party consents (e.g. landlord or building approvals).
  • Use the products only in accordance with our instructions and Nigerian law.

9. Limitation of Liability

To the maximum extent permitted by Nigerian law, MGM Energy is not liable for any indirect, incidental, special, or consequential damages (including loss of profits, business interruption, or data loss) arising from your use of our Site or products.

Our total liability in respect of any claim arising under these Terms shall be limited to the amount you paid to us for the specific order or project giving rise to the claim.

10. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is owned by or licensed to MGM Energy and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any content without our prior written consent.

11. Data Protection and Privacy

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Nigeria.

We may update these Terms from time to time. The "Last updated" date will be revised accordingly. Continued use of the Site or our services after changes are posted constitutes your acceptance of the updated Terms.
